    En el presente trabajo se estudian los límites de la autonomía privada desde la perspectiva del derecho a la igualdad y del principio de no discriminación tanto en el derecho norteamericano como en el europeo, con especial incidencia a la doctrina española. Por un lado se plantea si la piedra angular a la hora de establecer límites a la autonomía privada debe ser el concepto de dignidad o el de igualdad, por otro superando dicho debate se propone un acercamiento al problema entendido como una colisión entre derechos fundamentales en la que en cada concreto supuesto ha de estudiarse cual debe prevalecer. Finalmente se estima conveniente seguir el modelo de la Constitución de Sudáfrica y entender que los derechos fundamentales afectan directamente tanto a las relaciones horizontales como verticales, es decir tanto al ámbito público como privado.Universidad de Málaga.     Empirical likelihood confidence intervals for complex sampling designs

    We define an empirical likelihood approach which gives consistent design-based confidence intervals which can be calculated without the need of variance estimates, design effects, resampling, joint inclusion probabilities and linearization, even when the point estimator is not linear. It can be used to construct confidence intervals for a large class of sampling designs and estimators which are solutions of estimating equations. It can be used for means, regressions coefficients, quantiles, totals or counts even when the population size is unknown. It can be used with large sampling fractions and naturally includes calibration constraints. It can be viewed as an extension of the empirical likelihood approach to complex survey data. This approach is computationally simpler than the pseudoempirical likelihood and the bootstrap approaches. The simulation study shows that the confidence interval proposed may give better coverages than the confidence intervals based on linearization, bootstrap and pseudoempirical likelihood. Our simulation study shows that, under complex sampling designs, standard confidence intervals based on normality may have poor coverages, because point estimators may not follow a normal sampling distribution and their variance estimators may be biased.<br/

    The extremely asymmetric radio structure of the z=3.1 radio galaxy B3 J2330+3927

    We report on 1.7 and 5.0 GHz observations of the z=3.087 radio galaxy B3 J2330+3927, using the Very Long Baseline Array (VLBA), and archival 1.4 and 8.4 GHz Very Large Array (VLA) data. Our VLBA data identify a compact, flat spectrum (\alpha_{1.7 GHz}^{5 GHz} = -0.2 +/- 0.1; S_\nu ~ \nu^\alpha) radio component as the core. The VLA images show that the fraction of core emission is very large (f_c \approx 0.5 at 8.4 GHz), and reveal a previously undetected, very faint counterjet, implying a radio lobe flux density ratio R >= 11 and a radio lobe distance ratio Q \approx 1.9. Those values are much more common in quasars than in radio galaxies, but the optical/near-IR spectra show a clear type II AGN for B3 J2330+3927, confirming that it is indeed a radio galaxy. Unlike all other radio galaxies, the bright Ly-\alpha emitting gas is located towards the furthest radio arm. We argue against environmental and relativistic beaming effects being the cause of the observed asymmetry, and suggest this source has intrinsically asymmetric radio jets. If this is the case, B3 J2330+3927 is the first example of such a source at high redshift, and seems to be difficult to reconcile with the unified model, which explains the differences between quasars and radio galaxies as being due to orientation effects.Comment: 6 pages, 3 figures, to appear as a Letter to MNRA

    Highly-efficient noise-assisted energy transport in classical oscillator systems

    Photosynthesis is a biological process that involves the highly-efficient transport of energy captured from the sun to a reaction center, where conversion into useful biochemical energy takes place. Even though one can always use a quantum perspective to describe any physical process, since everything follows the laws of Quantum Mechanics, is the use of quantum theory imperative to explain this high efficiency? Making use of the quantum-classical correspondence of electronic energy transfer recently introduced by Eisfeld and Briggs [Phys. Rev. E 85, 046118 (2012)], we show here that the highly-efficient noise-assisted energy transport described by Rebentrost et al. [New J. Phys. 11, 033003 (2009)], and Plenio and Huelga [New J. Phys. 10, 113019 (2008)], as the result of the interplay between the quantum coherent evolution of the photosynthetic system and noise introduced by its surrounding environment, it can be found as well in purely classical systems. The wider scope of applicability of the enhancement of energy transfer assisted by noise might open new ways for developing new technologies aimed at enhancing the efficiency of a myriad of energy transfer systems, from information channels in micro-electronic circuits to long-distance high-voltage electrical lines.Comment: 4 pages, 3 figure

This is an open-access article distributed under the terms of the Creative Commons Attribution License (CC BY).Background: The approximate 5:1 male to female ratio in clinical detection of Autism Spectrum Disorder (ASD) prevents research from characterizing the female phenotype. Current open access repositories [such as those in the Autism Brain Imaging Data Exchange (ABIDE I-II)] contain large numbers of females to help begin providing a new characterization of females on the autistic spectrum. Here we introduce new methods to integrate data in a scale-free manner from continuous biophysical rhythms of the nervous systems and discrete (ordinal) observational scores. Methods: New data-types derived from image-based involuntary head motions and personalized statistical platform were combined with a data-driven approach to unveil sub-groups within the female cohort. Further, to help refine the clinical DSM-based ASD vs. Asperger's Syndrome (AS) criteria, distributional analyses of ordinal score data from Autism Diagnostic Observation Schedule (ADOS)-based criteria were used on both the female and male phenotypes. Results: Separate clusters were automatically uncovered in the female cohort corresponding to differential levels of severity. Specifically, the AS-subgroup emerged as the most severely affected with an excess level of noise and randomness in the involuntary head micro-movements. Extending the methods to characterize males of ABIDE revealed ASD-males to be more affected than AS-males. A thorough study of ADOS-2 and ADOS-G scores provided confounding results regarding the ASD vs. AS male comparison, whereby the ADOS-2 rendered the AS-phenotype worse off than the ASD-phenotype, while ADOS-G flipped the results. Females with AS scored higher on severity than ASD-females in all ADOS test versions and their scores provided evidence for significantly higher severity than males. However, the statistical landscapes underlying female and male scores appeared disparate. As such, further interpretation of the ADOS data seems problematic, rather suggesting the critical need to develop an entirely new metric to measure social behavior in females. Conclusions: According to the outcome of objective, data-driven analyses and subjective clinical observation, these results support the proposition that the female phenotype is different. Consequently the “social behavioral male ruler” will continue to mask the female autistic phenotype. It is our proposition that new observational behavioral tests ought to contain normative scales, be statistically sound and combined with objective data-driven approaches to better characterize the females across the human lifespan.Peer reviewe

    A characterization of 3D steady Euler flows using commuting zero-flux homologies

    We characterize, using commuting zero-flux homologies, those volume-preserving vector fields on a 33-manifold that are steady solutions of the Euler equations for some Riemannian metric. This result extends Sullivan's homological characterization of geodesible flows in the volume-preserving case. As an application, we show that the steady Euler flows cannot be constructed using plugs (as in Wilson's or Kuperberg's constructions).     Perceptions and determinants of partnership trust in the context of Community-Based Participatory Research

    Trust is difficult to conceptualize and define because of its diverse applications in different disciplines. Historic mistrust between vulnerable communities and researchers based on past adverse experiences can negatively affect the ability to collaborate and conduct effective research with such populations. Community Based-Participatory Research (CBPR) is a collaborative approach to research that can reduce historic mistrust and health disparities among minority populations. Although how trust development occurs in CBPR partnerships has been explored, there is a need to determine how to move from one stage to the next in fostering and maintaining that trust. The present study contributes to this discussion by addressing the lack of a shared operational definition of partnership trust and of how to measure it in the CBPR literature. We modified Dietz and Den Hartog’s (2006) Multi-dimensional Measure of Trust Model to investigate contextual factors that influence perceptions and development of trust in collaborative partnerships pursuing the reduction of health disparities. We conducted focus groups and key informant interviews with English and Spanish speaking stakeholders of a culturally relevant health promotion organization in the southeastern United States. Stakeholders reported experiencing different types of partnership trust depending on their role, and the length and nature of involvement with the organization. We identified determinants of partnership trust among stakeholders, including organizational, socio-economic, and cultural determinants. Most study participants agreed that trust with Hispanic communities is built slowly, with personal face-to-face contact and follow-up, and that engaging stakeholders throughout the process of working together in an intentional way is vital to building and maintaining trust. Findings of this study will inform the development of a culturally and linguistically relevant quantitative instrument to measure partnership trust in the context of CBPR
